Nintendo told me not to make fangames - should I ask them about these hacks as well?

I know there is the claim that this website does not exist to make illegal content, so I'm glad that we are making sure that we are doing legal stuff.

The message I got:
"Thanks for writing. We applaud your efforts at game development and encourage you to become a developer if you haven't already done so. Please understand, however, that you do not have our permission to develop software using Nintendo trademarks—even if you become a licensed Nintendo developer. Games featuring Nintendo trademarks are usually developed internally or by business partners. Please focus your efforts on creating your own intellectual property as you develop your software."
Why would you straight up ask Nintendo if you could make stuff with their intellectual property? Everyone who hasn't been living under a rock for the last few years knows Nintendo overzealously goes after fan projects.

Then, knowing the response you were given and also Nintendo's general attitude towards fan projects, what purpose would it serve to message them again about us except as an attempt to shut us down?


We host patches, not their original copyrighted work; there's no way Nintendo doesn't already know about us; blah blah blah we've had this argument since the beginning of the site and there's no discussion value to it anymore.
