Nintendo Rom hacking in danger?

So on Retouch, and some other rom sites, Nintendo took down roms for their games. Does this mean we might be in danger if nintendo knows about this? #smrpg{gasp}

Stuff gets taken down from rom sites all the time. It is illegal to distribute them, you know.
*everything stops*
Yeah, that's me. You're probably wondering how I got into this situation...
*cut to next post*
I am fairly certain Nintendo is well aware of this site, and if they wanted to take action they already would have.

We don't host ROMs here as it's illegal to distribute them, and if we were to host them we'd have a much greater chance at being taken down than now. It's the reason why we only allow people to upload their hacks in .bps formats. That .bps file alone won't be playable and you'd actually have to go through the trouble to find a ROM somewhere, which is on a site that has nothing to do with SMWCentral.

Don't worry about it, we're safe.

Sure, Kieran gets money from but he spends it to keep the site alive.

So does that mean that Nintendo doesn't take SMWC down because Kieran pays them?

What, no. All the money that Kieran gets through donations goes towards this site. Nobody has or should ever have to pay Nintendo for whatever unless you're actually buying one of their consoles.
Nintendo doesn't take down SMWC because we don't host ROMs of their games, and even the graphics we host from their games are in a format that they care about less than if we just hosted png sheets of them.

Either distributing ROMs or linking to them is forbidden here. We're safe since we only distribute BPS patches to our ROMs but when we're getting started to SMW hacking, we're also forced to go through hell of looking for a headered ROM of Super Mario World since ROMs get taken down all the time. Running BPS files themselves on an emulator is impossible so we need to use Floating IPS and the headered SMW ROM to patch our ROMs.

The question had already been answered and then people echoed the answer for some reason and now the previous posts aren't even being read. This is going nowhere, so.
If we get a C&D, I won't spend that much time on computer/mobile if the website and SMW hacking dies. But this doesn't mean I won't be using the computer to play games.

I personally do expect a C&D around the release of the SNES Mini, seeing as Nintendo will be making an active profit off of Super Mario World when it comes out, but I don't think it would kill SMW hacking. I'm no legal expert, but apart from the hacks database (i.e. a massive collection of fan games), there's really nothing here to infringe their intellectual property. The site's name is SMWCentral (the acronym could be referring to anything) and the graphics used in the default theme could be replaced. I highly doubt they'll nuke the whole community out of orbit (maybe just the hack databases and things like all.log), especially if we stay quiet. So far they've only taken down massively popular things, such as AM2R, which was, in my opinion, more hyped than Federation Force (I didn't even realize that had come out), and Pokémon Prism, which had a trailer and a Facebook page. They didn't even touch pret's projects (full disassemblies of the Generation I and II Pokémon games which compile into the commercial ROMs), which Pokémon Prism was based on AFAIK.

And even with if this website does go away, Super Mario World hacking has existed for more than 10 years. We'll probably just move to a different board (or to the Discord). But, as many people have pointed out, we don't host ROMs or full disassemblies, we're just a forum with links to fan games attached to it (and those could be moved somewhere). When they C&D'd Game Jolt, they only took down the Mario games, not the whole website.

And of course, there's this:

So, I think there needs to be clarity in what the line is, and, in our view, the line is when an initiative crosses from being an homage to something that is monetizing our IP. We allow homages to exist in a variety of different ways. And, for me personally, as a fan before I was an executive, I understand the attraction that you could have to our IP. But, when it transitions to something that… now, you’re trying to monetize, you’re trying to sell, you’re trying to profit off of, that is what broaches or breaks through that line for us, where we have to claim our IP protection.

We don't sell ROM hacks. The only money this website makes is from ads, and those are to run the website itself, they'd exist even if it was just a forum.
They didn't hit us when Super Mario Maker came out. I doubt they'll hit us in the future.
I hope we don't get a C&D. At least they won't get rid of ROM hacking though but this site might be in danger. A C&D might come around the release of the SNES Mini as telinc1 said. FPzero might be right, though. However, SMM wasn't the full Super Mario World but was still very similar to ROM hacking.

I'd say our chances of a C&D wouLd be slim.
Working on "A Mario Hack".
You guys realize that it's possible to not find roms eventually, right?

Er... what?
Roms have been around since the beginning of the internet. They've been downloaded and rehosted millions of times over.
I doubt a couple of rom site takedowns would result in the end of rom distribution altogether.

because once you've downloaded it Nintendo can't delete it from your computer. If we get a C&D, ROM hacking won't die but it won't be as fun if SMW Central will. But I bet we can share our hacks via Discord or Skype or some other chat app.
