I personally do expect a C&D around the release of the SNES Mini, seeing as Nintendo will be making an active profit off of Super Mario World when it comes out, but I don't think it would kill SMW hacking. I'm no legal expert, but apart from the hacks database (i.e. a massive collection of fan games), there's really nothing here to infringe their intellectual property. The site's name is SMWCentral (the acronym could be referring to anything) and the graphics used in the default theme could be replaced. I highly doubt they'll nuke the whole community out of orbit (maybe just the hack databases and things like all.log), especially if we stay quiet. So far they've only taken down massively popular things, such as AM2R, which was, in my opinion, more hyped than Federation Force (I didn't even realize that had come out), and Pokémon Prism, which had a trailer and a Facebook page. They didn't even touch pret's projects (full disassemblies of the Generation I and II Pokémon games which compile into the commercial ROMs), which Pokémon Prism was based on AFAIK.
And even with if this website does go away, Super Mario World hacking has existed for more than 10 years. We'll probably just move to a different board (or to the Discord). But, as many people have pointed out, we don't host ROMs or full disassemblies, we're just a forum with links to fan games attached to it (and those could be moved somewhere). When they C&D'd Game Jolt, they only took down the Mario games, not the whole website.
And of course, there's this:
Originally posted by Reggie, desperately trying to explain why they took down AM2RSo, I think there needs to be clarity in what the line is, and, in our view, the line is when an initiative crosses from being an homage to something that is monetizing our IP. We allow homages to exist in a variety of different ways. And, for me personally, as a fan before I was an executive, I understand the attraction that you could have to our IP. But, when it transitions to something that… now, you’re trying to monetize, you’re trying to sell, you’re trying to profit off of, that is what broaches or breaks through that line for us, where we have to claim our IP protection.
We don't sell ROM hacks. The only money this website makes is from ads, and those are to run the website itself, they'd exist even if it was just a forum.
