It is illegal to download ROMs from the internet but editing them...

eh, you can read threads like this one for concrete answers. Nintendo has shown a no-tolerance policy for ROMs but it seems they are not really interested.
As Everest said, downloading ROMs is illegal, but editing them to make your "own" game out of it shouldn't be illegal AS LONG as you don't distribute or sell them anywhere, that's also the reason we use .ips patches to release our rom hacks.

I know that only ips hacks are acceptable and roms is an instant removal. But by hearing the sentence "It is illegal to download roms from the internet" That frightened me, and knowing that nintendo suing websites that hosting roms makes me think in the future; super mario world wouldn't exist... i couldn't show the website hosting roms (but a link to a youtube should be acceptable) because not only it will violate the rules, if nintendo sees any sites that do this, it will be all over because super mario world is entirely gone!) as smw hacking productions will fade!
It also takes one nintendo to google smw rom and then that site is terminated roght off the bat. Can you imagine how painful it will impact to smw central and people who plays smw hacks?

It will be extremely hard for Nintendo to go after every single one since ROMs have been available for years. Nintendo is also not paying much attention to this as I earlier said.

but what if the
sopa-related laws
(one of them passed) can remove that website. because there are tons of "police" or copyright enforcement that aid nintendo to "team" up and delete smw in a fast rate (because there are "helps" of removing it).

I hope nintendo doesn't get revenge on these websites.
*the sentence lowers my a worry a little since I hear the quote "once something is on the internet, is in the internet forever". but i could think that smw maybe be the exception or not.

However, if one of the sites that everyone download the most have permission/authorized, my worries stopped and everything will be normal.

And someone can simply report rom in the websites and this can be all over...

No matter what, this is the internet, once something is on it, it never goes away, there is always a copy somewhere. As much as Nintendo may try and stop roms (they really don't put that much effort in it) they will never be able to get rid of them. Just like SMBX which got a cease and desist on it years ago and was removed by the actual creator you can find a copy of it pretty much anywhere, even though Nintendo said that it can't be publicly available anymore.

No, us using .ips patches is not because we're not allowed to distribute our hacks or sell them, it's because there's copyrighted code in every ROM (like the Mario physics, standard sprites etc), which would be illegal to share, so .ips files only contain our changes to the original game.

Besides, Nintendo knows about the hacking scene, as can be proven by very old IP logs from FuSoYa's site (a Nintendo IP accessed his site very early on), and, in an interview with Miyamoto, it was actually brought up to them directly as I was just told, and all Miyamoto had to say about it was that it was 'quite charming'.

Yea I shouldn't worry, since the sites hosting roms was living for many years. Because the roms are created into the internet and last very long for 2 reasons:

- because the websites hosting roms for so long, it should have permission/authorized to distribute, if not, it should be wipe out soonly due to reports.

- people missed classic games on the internet so they convert them to a software so people can play classic games anytime. (Its also better since it has no crash due to it doesn't have a scratch on the cartridge.)

We should be legal because the ips only contain changes in the rom. The unchanged parts of the rom are filtered out.
so:

Super Mario World.smc = not allowed reguardless of the file name before the ".smc"

hackname.ips = allowed since it only contains edits parts of the rom.

Seems almost like 20 years and not many sites hosting ROMs doesn't get taken down. Looks like they give up because there are too many. Like that being said, IPS is the safest way to submit your hack than a rom.

Illegal, but popular. Just like the 1900s the prohibition act - if someone wanted something, they get it illegaly.

If you have a game, then basically you are allowed to have a ROM of it.
If you dont, then you definitely arent allowed to play it.
But we cant hack the cardridge and neither did Nintendo create all those Romhacks...
