Just so you know, the Twitch streamer Trihex has been blatantly making money off of your work by reselling the rom hacks you guys made yourself reprogrammed into Yoshi's Island carts.

Yes, I told Alexander that I don't mind MY game being put on a cartridge as long as no further modifications are made. I already knew that my hack was to be put on a cartridge, since Alexander and me have been PMing a little lately and I was fine with that.
However, at least asking the other creators of the hacks is due to respecting other people's work (I don't think copying the game on a cartridge is as much work as creating a hack), so it's still not a nice thing to do, especially when it comes to selling it.
With that said, I'm not the voice of all YI hackers on this site, I'm just moderating this forum; delivering complaints or objections towards Trihex is none of my business, let alone initiating legal steps (hacking itself is legal limbo anyways).

Romhacking itself is using Nintendo's intellectual property. Beyond that, the romhacks are freely accessible to anyone. What is being sold is the hardware manipulation required to use it on a console, almost all of which is going to the guy creating them not Trihex btw.

This is like saying, "you're not allowed to sell a device to read a book, furthermore the book isn't even a real published book but a fanfic, and the fanfic is freely available online." Or for example, you can't just make a remix of a licensed song and expect to have any rights to it, that's just silly.

Imagine of all 10,000 SMW romhack creators said SD2SNES had to stop selling its product because people were using it to play their romhacks.

That being said, it would suck if what Trihex were doing were going against the intent of the romhack creators. But quite the opposite, he is providing incredible exposure which is massively benefiting the yoshi's island and romhack communities.

Agreed, this invalidates any perceived grievance romhackers have, unless they can cite any copyright law

You would need the cart creator to disclose received payments per "pre-ordered" cart to consider reaching this conclusion.
One fact is that Trihex is charging an extra $50 if a NTSC-U Yoshi's Island cart is not provided. At the time of this posting, I can purchase said cart for ~$21 on ebay. This refutes the claim of "almost all" the purchase price going to the creator for orders not providing carts.

I would agree as both use existing universes/engines and existing characters/resources, except the issue isn't capability but rather that the device is pre-loaded with content.

Agreed, but selling a device with this content is questionable.
The caveat for all of this is that I am not an expert on copyright law concerning modified copyrighted content

I think you posted this before mentioning it in IRC, but SD2SNES doesn't include any pre-loaded content, to my knowledge.

It is commendable that he took the necessary courtesies to contact the romhack authors, but they possess no legal right to consent to the inclusion of pre-loaded romhacks since they hold no intellectual property rights.
Any "Massive benefit" is debatable, and could be done without reselling carts with pre-loaded romhacks.
Yes, being angry at him for selling them is a little pointless, I don't believe he will find tens of thousands of people buying them and I don't believe he will magically become rich from selling some.
As for the cart, a Yoshi's Island cart needs additional hardware, namely the SuperFX2 chip (I don't know about other chips, but a SuperFX2 is required).
I really like the idea of playing the hacks on a real console, though.
But first let me farm 999 lives for Secret 6 ^^

Yep, this is entirely true. He relayed the whole selling thing to me (great guy, by the way) and I think I responded with "lol cool" or something along those lines. There's nothing ROM hackers can do to stop people form selling their hacks on cartridges, nor should they try/care.

I agree. It would be fun to see them on a real SNES, and I wanted to out my game on a cartridge, but I'm not that far yet, and it seems really complicated.

Also, I do not think they should be able to make money from someone else's game.

I've been making reproductions by myself as well (and no I don't sell them). And I won't mind helping out with that!

The price is too high even if it was a original cartridge with the corresponding PCB.

Now, what do people pay $150 for?
Yoshi's Island = around $20
27c160 EPROM = $2 per

Desoldering/Soldering + burning that thing should be $5-$10, since not everyone can afford an EPROM programmer.

That's roughly $30 ($50 if you want a little profit, which isn't too bad yet I still dislike that) for a reproduction of Yoshi's Island. A homemade PCB won't cost $120. That's alot of profit there. >_>

May I ask what kind of console you use to run them? I'm not entirely sure, whether the PAL/NTSC issue depends on software or hardware, so do you run them on a European SNES or a North-American SNES or maybe even a Super Famicom? I'm pretty sure the Hack-Carts by Trihex (respectively whoever creates them) run on a North-American SNES so I have to have my SNES modded to play, but that's more than worth it =)

Usually Yoshi's Island has a build in protection that displays "This Game Pak is not designed for your Super Nintendo/Super Famicom if played in a wrong console ($213F Check). However, I removed the original lockout chip of the cartridge and replaced it with a custom CIC which still will display the above message but works in all SNES assuming the region matches!

My SNES instead is a PAL SNES modded to its finest. (SuperCIC + ultimateInGameReset + D4 Patch)

SuperCIC allowing me to bypass the lockout chip allowing me to play all SNES games.
uIGR allowing me to change the region via controller plus resetting the console as well as bypassing the above message (Game Pak not for your SNES/SFC) aka D4 Patch. Pretty handy stuff. ;)
I'm a so sick of people coming on these sites talking about how SOMEONE ELSE is repro-ing SOMEONE ELSE's hack and trying to pretend to be a hero when all you're doing is making an ass out of yourself for something you have no understanding of. Do you even think Nintendo's legal team gives a shit about your hack being sold out here? They got way bigger problems than that. As long as their not loosing a big portion of money they don't/shouldn't give a shit.

And mind your own fucking business and learn what Rom-hacking rights are really about.
